The Revised Conflict of Interest Statutory Guidance for CCGs, issued in June 2017, states: “There will be situations when interests will not be identified, declared or managed appropriately and effectively. This may happen innocently, accidentally, or because of the deliberate actions of staff or organisations. For the purposes of this guidance these situations are referred to as ‘breaches’.
In accordance with this wider definition of a “breach”, NHS Kernow has reported to NHS England the actual conflict of interest arising from our Interim Chief Operating Officer’s spouse being employed by Cornwall Partnership Trust in a senior position. The Executive team and Audit Committee have agreed appropriate mitigations that are now in place and significantly reduce the risk of an actual breach occurring. We will be open and transparent about this matter and continue to monitor the situation appropriately.
